Terms of Service

Please read these Terms of Service carefully before using DispatchFast. These Terms constitute a legally binding agreement between you and DispatchFast regarding your use of our document generation and signing platform.
1. Acceptance of Terms
By accessing or using DispatchFast ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including brokers, dispatchers, and any other individuals who access the Service on behalf of an organization.
2. Description of Service
DispatchFast is a document generation and electronic signing platform built for auto transport brokers. The Service allows users to create orders, generate documents (including dispatch sheets, gate passes, bills of lading, and invoices), collect electronic signatures, and manage document workflows. DispatchFast is not an order management system, load board, or transportation management system (TMS).
3. User Accounts
You must create an account to access the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at hello@dispatch-fast.com if you suspect any unauthorized use of your account. DispatchFast reserves the right to terminate accounts that violate these Terms.
4. Orders and Documents
You are solely responsible for the accuracy and completeness of all order data, document content, and information you enter into the Service. DispatchFast does not verify the accuracy of vehicle information, VINs, addresses, or any other data you provide. Electronic signatures collected through the Service are legally binding under applicable law, including the Electronic Signatures in Global and National Commerce Act (ESIGN). Once a document is signed, it cannot be edited or altered through the Service.
5. Payment Terms
Subscription fees are billed in advance on a monthly or annual basis depending on your selected plan. All fees are non-refundable except as required by applicable law. We reserve the right to change pricing upon 30 days' written notice. Failure to pay may result in suspension or termination of your account. Payments are processed securely through Lemon Squeezy.
6. Acceptable Use
You agree not to use the Service to: (a) violate any applicable law or regulation; (b) transmit false, misleading, or fraudulent information; (c) infringe the intellectual property rights of others; (d) transmit any malicious code or interfere with the Service's infrastructure; (e) attempt to gain unauthorized access to any portion of the Service; or (f) use the Service for any purpose other than legitimate auto transport brokerage operations.
7. Intellectual Property
The Service and its original content, features, and functionality are owned by DispatchFast and are protected by intellectual property laws. You retain ownership of all data and content you submit to the Service. By using the Service, you grant DispatchFast a limited license to process and store your data solely to provide the Service. We do not sell or share your data with third parties for marketing purposes.
8. Data Security
DispatchFast employs industry-standard security measures to protect your data, including encrypted storage and secure transmission. However, no method of transmission over the Internet or electronic storage is 100% secure. You acknowledge that you provide data at your own risk and that DispatchFast cannot guarantee absolute security.
10. Disclaimers
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. DispatchFast does not warrant that the Service will be uninterrupted, error-free, or free of viruses. We are not responsible for any documents that fail to generate or transmit due to technical issues, third-party service outages (including Twilio, Resend, or Cloudflare R2), or errors in data you provide.
11. Limitation of Liability
To the maximum extent permitted by law, DispatchFast shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or goodwill. In no event shall DispatchFast's total liability to you exceed the amount you paid for the Service in the twelve (12) months preceding the claim.
12. Termination
Either party may terminate these Terms at any time. You may cancel your subscription at any time through your account settings. Upon termination, your right to access the Service will immediately cease. DispatchFast may retain your data for up to 90 days after termination, after which it will be permanently deleted unless otherwise required by law.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that either party may seek injunctive relief in a court of competent jurisdiction.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes via email or a prominent notice on the Service. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of those Terms.
